Liability Release Agreement *

Consult your physician and follow all safety instructions before beginning any exercise program, especially if you have a known medical condition or are currently taking any medication. Purpose of this Binding Agreement: By reading and signing this document “You”, the undersigned, agree to release and hold Elevate Performance, LLC and its principals, officers, members, employees, agents, and assigns (collectively hereafter referred to as “Elevate”) harmless, and You assume all responsibility for all claims, damages, or injuries You suffer except those resulting from willful, wanton or intentional Acts of Elevate. Representations: You represent that you understand that Your use of Elevate premises, facilities, equipment, and services/programs includes an inherent risk of injury to persons and property and that You are in good physical condition and have no other conditions that could prevent You from exercising and using Elevate’s equipment and services without injuring yourself or impairing your health. You further represent that you have either 1) consulted a physician or had a physical examination and as a result have received your physician’s permission to participate or 2) have decided to participate in Elevate services/programs without the approval of your physician and You do hereby assume all responsibility for your health and any injuries, claims or damages you may suffer. Express Assumption of All Risks: You hereby acknowledge that you understand and appreciate all of the risks associated with your use of Elevate equipment or facilities, and your participation in Elevate services/programs, including the risks of injury, disability and death, and hereby assume such risks. Agreement and Release of Liability: In consideration of being allowed to participate in the activities and programs of Elevate and to use its equipment/facilities, You do hereby waive, release, and forever discharge Elevate from any and all liability for damages and injuries, including disability or death, resulting from your use of Elevate premises or equipment or from you participation in any Elevate programs/services, except damages that result from the willful, wanton or intentional misconduct of Elevate.
